LEGAL NOTICE - CONDITIONS OF SALE


The products you (the “Buyer”) are about to order are purchased by OLDE WOOD, LTD. from its location in Magnolia, Ohio (“OLDE WOOD”) from multiple sources in rough stock form. Once ordered, they are custom milled to your exact specifications. As a result, they become nearly impossible to resell. Accordingly, it is very important that you read and understand these terms and conditions of sale (“Terms and Conditions”) and the Products and Processes information attached hereto as Exhibit A (“Products and Processes”). Your indication of your consent, approval, and agreement on the proposal is a firm offer to purchase the products described on the order (the “Order”). Once the Order is reviewed and an acceptance by an authorized representative of OLDE WOOD is returned to you by email, it becomes a binding contract (the “Agreement”). OLDE WOOD’s acceptance of the Order is expressly conditioned upon your agreement to the Terms and Conditions and Exhibit A, without modification.

Flooring: If you are purchasing flooring materials, the following terms apply:

Flooring material needs an acclimation period and should be unbundled (or unboxed) and racked at the place of installation in a climate/humidity-controlled environment. Acclimation time frame is dependent on many factors including the conditions and climate at time of delivery. The goal is to ensure the moisture content of the wood is relative to the living conditions and remains consistent; generally, industry recommends a 30-50% humidity level and 60–80 degree temperatures. Industry acclimation recommendations for unfinished flooring is 7-10 days and finished flooring is 10-14 days. Acclimation is highly recommended in the room(s) it is to be installed. Do not stage flooring in a non-climate-controlled area as contact with other materials and environments can dramatically change moisture levels (ex: garage, shed, home/room with no HVAC, concrete floors). Industry recommends proper acclimation to the desired installation location no more than 30-days after delivery receipt. Hardwood flooring is hygroscopic by nature and will give off or take on moisture. There may be seasonal shrinkage and expansion due to change in moisture levels.

On reclaimed and Traditional Plank engineered flooring, platform may be visible through some of the below mentioned “historical imperfections”. The installer may be able to fill these areas in with wood filler and/or cut out based on Buyer preference and should be discussed and agreed upon with the installer.

Regarding installation and finish, each floor is unique and different and so is each installer. There are many different techniques involved in installing a reclaimed or Traditional Plank floor. Installation techniques and finishes should be discussed and agreed upon with the installer. Having your installer produce a sample prior to install is also highly recommended. OLDE WOOD also recommends adhering to the National Wood Flooring Association guidelines.

When ordering prefinished products, the finish only covers the face of the wood and not the sides or tongue and groove. In products containing over/under wood (usually hit-skip or sawn faces), there is the potential to see the unfinished edge of the plank when installed. This is normal and acceptable.

If a random width floor was ordered, please note that each floor is produced for optimal yield and the width results vary with each floor. Random width flooring is more traditional and available in a number of width ranges. Random width in no way guarantees you will receive a percentage of any one width. Prior to installation of a random width floor, the installer should read over the tally sheet which shows the quantities of each width included in the order and decide on how they will lay the floor utilizing the full amount of each width. Do not start installing the floor in a sequential pattern or you will most likely run short on one or more specific widths. If the customer would like to install sequentially (3,4,5,6,3,4,5,6,3,4,5,6…..) this is an equal lineal footage floor and would need to be ordered with specified quantities of each width. Specified widths are available upon request. Please ask your Sales Rep for information and pricing if you would like this option.

Beams & Boards: If you are purchasing beams and/or boards, the following terms apply:

Beams and boards are not always guaranteed to be free of dirt, paint (including lead-based paint), metal, insects or other contaminants. Although OLDE WOOD’s suppliers attempt to remove dirt, paint, metal, insects, etc., Buyer is responsible for verifying that materials are fit for desired use. Beams and boards are surface denailed only. Buyer acknowledges and agrees that nails and other foreign objects may exist below the surface. OLDE WOOD is not responsible for loss or damage caused by the existence of subsurface imperfections and foreign objects. Unless specifically noted as being kiln dried or fumigated, products are not kiln dried, fumigated, or otherwise treated.

Reclaimed beams are not perfectly straight or without variation throughout the timber. Beams will show historical imperfections including (but not limited to) natural weathering, authentic cuts, artifacts, waned edges, peg holes and mortise notch pockets. The installer may be able to fill these areas in with wood filler and/or cut out based on Buyer preference and should be discussed and agreed upon with the installer.

Beam and board Orders are typically mixed species unless otherwise noted.

On beams and dimensional material, where lengths are specified, OLDE WOOD does not cut to size and reserves the right to send fewer and longer pieces for field cutting to lengths required (overages may apply). Final price may be higher due to length overages. Overage percentages will vary by product and job and can be as high as 15%- 20% (for example: If Buyer orders a 10-inch x 10-inch x 16 feet beam, OLDE WOOD may ship a 10-inch x 10-inch x 18 feet and invoice Buyer for the extra two feet).

OLDE WOOD is not liable for the structural integrity of any beam or board material provided. The primary use of the board and beams is for aesthetic purposes only. If Buyer wishes to use these boards, beams, or other timbers for structural purposes, OLDE WOOD will not be responsible for any additional costs including, without limitation, the costs of inspection, approval, and installation by a certified engineer licensed in the same jurisdiction where the Buyer’s project is located.

Beam and board dimensions are nominal and can vary from the dimensions set forth on the Order, unless otherwise noted. Buyer acknowledges and agrees that there will be some variation in reclaimed and Traditional Plank wood dimensions. Reclaimed timbers (primarily hand-hewn beams) may have a variance of 1” to 2” for both height and width.

Pre-Finished Products: If you are purchasing pre-finished products, the following terms apply:

For products that have a natural oil-based finish, please unpackage the product as soon as possible to allow the natural finish to cure completely and follow all other instructions for acclimation of flooring products as described above. Pre-finished products may have “historical imperfections,” many of which will be filled during pre-finish to provide a quality product. The cost of Pre-finish depends on the finish ordered. Larger orders may cost less compared to smaller orders of the same product and finish. When ordering prefinished products, the finish only covers the face of the wood and not the sides or tongue and groove. In products containing over/under wood, there is the potential to see the unfinished edge of the plank when installed. This is normal and acceptable. During the process of sanding and finishing, the thickness of the flooring will be adjusted to create a high-quality finished product. If you have any other questions, please feel free to ask your sales representative.

LIMITED WARRANTY: Standard UV-cured and natural oil pre-finish flooring planks carry a 20-year residential and 5-year commercial limited warranty. This limited warranty is void if any cleaners are used on the floor other than the recommended OLDE WOOD cleaning products. This limited warranty covers only the proper application and adhesion of the finish to the wood and does not cover natural wear due to Buyer’s use. The manufacturer of the natural oil used by OLDE WOOD recommends that a fresh coat of natural oil be applied to the product once it has been installed (manufacturer’s maintenance recommendations are available at: (http://www.oldewoodltd.com).


General: The following terms apply to all Orders:


All Orders require the payment of a 50% non-refundable deposit to begin processing the Order (the “Deposit”). FINAL BALANCE DUE MUST BE PAID-IN-FULL PRIOR TO SHIPMENT OF MATERIALS. Deposits paid on Orders cancelled within 7 days of receipt of deposit by OLDE WOOD will be refunded unless production of the Order has begun. If production has begun and the Order is cancelled within 7 days of receipt of Deposit by OLDE WOOD, a 20% restocking fee will apply. Deposits paid on Orders cancelled more than 7 days from receipt of Deposit by OLDE WOOD are non-refundable. If a credit card was used for the Deposit, refunds, if any, will be subject to a 3% credit card transaction fee.

Checks should be made payable to OLDE WOOD, LTD. Credit cards (Visa, Mastercard, and AmEx) and wire transfers are also acceptable forms of payment. Payment by credit card will be subject to a 3% credit card transaction fee.

WAREHOUSING STORAGE SERVICE: If your order is not paid in full and/or shipped within 5 business days of the completion date, Olde Wood will store your order until these requirements are met. OLDE WOOD will charge Buyer $250.00 per pallet per month for this warehousing storage service on any orders that have been completed and invoiced for more than 5 business days. This storage service will be invoiced each month and all invoices must be paid in full prior to the order shipping.

Any order not paid in full within 30 days of completion shall be considered canceled, at the sole discretion of OLDE WOOD. All deposits and rights to the Order will be forfeited by Buyer if the Order is cancelled by OLDE WOOD for failure of Buyer to pay.

All sales are made subject to Buyer’s payment of all applicable State, County, and City sales tax and/or use tax, including, without limitation, taxes on manufacture, sales, receipts, gross income, occupation, use and similar taxes, and exclusive of any duties, tariffs, import fees, or any other fees associated with imports and exports. Wherever applicable, any such items will be added to the invoice as a separate charge to be paid by the Buyer. Out-of-state buyers receiving products or services must pay state and local taxes where applicable.

IN NO EVENT SHALL OLDE WOOD BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, LOSS OF BUSINESS OR PROFITS, EVEN IF OLDE WOOD IS ADVISED, OR SHOULD HAVE KNOWN, OF THE POSSIBILITY OF SUCH DAMAGE OR LOSS. THE LIABILITY OF OLDE WOOD, WHETHER IN CONTRACT, TORT, OR OTHERWISE, AND ANY AND ALL DAMAGES IMPOSED UPON OLDE WOOD SHALL IN NO EVENT EXCEED THE AMOUNT PAID BY BUYER TO OLDE WOOD FOR THE PRODUCTS SUBJECT TO THE CLAIM. FURTHERMORE, IN THE EVENT THAT ANY PRODUCTS SHALL BE MANUFACTURED AND/OR SOLD BY OLDE WOOD TO MEET BUYER’S PARTICULAR SPECIFICATIONS OR REQUIREMENTS, OLDE WOOD SHALL NOT BE LIABLE FOR ANY FAILURE TO MEET PARTICULAR SPECIFICATIONS OR REQUIREMENTS, OR ANY CLAIM FOR INFRINGEMENT OF ANY PATENT OR ANY INTELLECTUAL PROPERTY RIGHTS, ARISING FROM THE BUYER’S PARTICULAR SPECIFICATIONS OR REQUIREMENTS FOR THE PRODUCTS. THE REMEDIES OF BUYER SET FORTH HEREIN ARE EXCLUSIVE AND ARE IN LIEU OF ALL OTHER REMEDIES.

Buyer acknowledges that the products of OLDE WOOD are natural products, which are subject to degradation and changes over time as any other naturally occurring product. OLDE WOOD will fill the order from the Buyer, but will not otherwise guarantee the product, other than as expressly set forth herein under the limited warranty above. Buyer acknowledges that many factors affecting the product are outside of the control of OLDE WOOD and are naturally occurring, such as temperature, moisture, transportation, and the condition of the wood at the time received by OLDE WOOD, none of which can be controlled by OLDE WOOD. Therefore, OLDE WOOD has no liability whatsoever for these naturally occurring conditions or the effect that they may have on the product. In addition to the other disclaimer provisions set forth herein, OLDE WOOD offers certain suggestions below on how to handle the product, but these do not constitute a warranty or guarantee regarding the product being sold.

OLDE WOOD is not liable for measurements set forth on the Order and assumes no responsibility as to the accuracy of lists prepared from plans, material lists, blueprints, drawings, and the like. Buyer is responsible for verifying the accuracy of the quantities, species, mill detail, sizes and other information included on the Order.

OLDE WOOD is not liable for any recommendations, opinions, or advice as to the choice, installation or use of products sold. Any such recommendations, opinions, or advice, to the extent given, shall be accepted at Buyer’s own risk and shall not constitute a warranty or guarantee of such products or their performance. OLDE WOOD’s disclaimer of warranty as set forth below shall not be affected by, and no obligation or liability shall arise or grow out of OLDE WOOD’s rendering of technical advice, installation advice or service in connection with Buyer’s Order or the products furnished hereunder. Buyer shall be solely responsible for selecting the installation contractor, assessing the validity of time and cost estimates for the installation contractor, and making all arrangements, supervising and paying all costs for the installation of the OLDE WOOD product. Buyer shall also be liable for conformance with all local laws and ordinances including zoning, building codes, building permits, inspections, and the like.

Manufacturing lead time begins from the Friday after both 50% deposit and approved Terms and Conditions are received, and order is created. Lead times are also based on product availability and production scheduling. Lead times are estimates and are not guaranteed dates that your material will be completed or ready to ship. Lead time is an estimate only and does not include transit time. Should OLDE WOOD be delayed in its performance for reasons which are beyond its control, including but not limited to weather, labor disputes, fire, natural disasters, war, acts of terror, civil strife or military action, accidents, delay of carrier, failure of production facility, or any similar cause, Buyer agrees to either (i) accept performance when it can be effected, or (ii) cancel the Agreement, in which case OLDE WOOD shall be entitled to retain the Deposit.

Unless specified in the Order, OLDE WOOD shall select the carrier for delivery. Olde Wood Limited is a manufacturer of wood products and not a shipping company. We are arranging the transportation of the order as a service to the Buyer. Cost of shipping and unloading of the shipment is the sole responsibility of Buyer unless otherwise expressly set forth in the Order. Freight costs are valid for one week and are based on the type of material, cubic space, weight, traveling distance, and normal unloading times. Freight costs are subject to change and will be calculated once the order is complete and final dimensions and weights are available. Freight costs will be billed as a separate invoice from your product order and will need to be paid in full prior to your order being released to ship. All product is shipped F.O.B. the place of manufacture as specified on the Order. Title and all risk of loss shifts to the Buyer upon the carrier’s acceptance of shipment. The Buyer shall file all claims for shipment shortages or damage directly with the carrier. Buyer will furnish any equipment/manpower necessary to safely unload products at THE delivery location. Buyer is responsible for unloading all material from the back of the delivery truck to the designated staging area. Please note that carriers do not typically pull into driveways but stay on the street. If the product will be hand unloaded, please inform OLDE WOOD at the time of deposit as hand unloading may exceed normal unloading times and result in additional delivery or unloading charges. Additional unloading charges will be the responsibility of the Buyer. Where the Order specifies that the products are to be delivered via a dedicated truck, the freight cost assumes that the delivery location is easily accessible to an 18-wheel semi-truck with 48’ (or possibly longer) trailer. Saturday deliveries are not available unless special arrangements are made. Saturday deliveries may incur additional delivery charges.

PLEASE NOTE THAT A SHIPPING COST WILL NOT BE AVAILABLE UNTIL THE ENTIRE ORDER IS PACKAGED AND READY TO SHIP. OLDE WOOD LIMITED IS NOT RESPONSIBLE FOR ADDITIONAL SHIPPING CHARGES THAT MIGHT BE INCURRED AT THE TIME OF DELIVERY.

All materials should be checked and inspected by Buyer upon receipt to ensure the shipment is not damaged and contents match the Order within five (5) days of the Buyer’s receipt of the materials. Buyer is encouraged to take and send pictures of any and all damaged material to OLDE WOOD. Any damage during shipping must be noted on the Bill of Lading when received. OLDE WOOD is not responsible for problems that may occur after shipment is received due to inadequate acclimation, storage, climate control or handling of materials. Any issues with or damage to products received must be reported within 7 days of Buyer’s receipt of materials or it shall be deemed accepted by Buyer. Any damage must be marked on the Bill of Lading received from the delivery company. Buyer must take pictures of any such damage and send them to customerservice@oldewoodltd.com. Upon receipt of notice, OLDE WOOD shall have the right to inspect and investigate to determine the validity of the defect, in its sole discretion. Upon timely rejection of defective products not damaged during shipping, Buyer shall, as its sole remedy and subject to OLDE WOOD’s investigation described herein, return such nonconforming or defective products to OLDE WOOD for replacement in accordance with OLDE WOOD’s established procedures. If OLDE WOOD determines the products to not be milled to the specifications agreed upon by OLDE WOOD for the order within the warranty period referenced above, the products may be replaced or repaired at the option of OLDE WOOD at its expense, including authorized transportation, but only if such claims are made in writing to OLDE WOOD within seven (7) days of Buyer’s receipt of the materials. BUYER ACKNOWLEDGES AND AGREES THAT OLDE WOOD’S LIABILITY FOR ANY VALID CLAIM UNDER THIS LIMITED WARRANTY SHALL BE LIMITED TO THE REPAIR OR REPLACEMENT OF THE PRODUCT OR RETURN OF THE AMOUNT PAID BY BUYER FOR THE AFFECTED PRODUCT. THE FOREGOING LIMITED WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES AND NO REPRESENTATIONS, GUARANTEES, OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE MADE BY OLDE WOOD IN CONNECTION WITH THE PRODUCTS. No employee, distributor, or representative is authorized to change this limited warranty in any way or grant any other warranty on behalf of OLDE WOOD.

Buyer acknowledges and agrees that reclaimed and Traditional Plank materials include “historical imperfections” including (but not limited to) sound/open knots, sound checking, nail holes, color variations and contrasts, worm holes, bolt holes, mortise notch pockets, peg holes, authentic cuts, artifacts, original surface patina, saw marks, over/under wood, sapwood, and natural weathering. Such historical imperfections are expected and are not grounds for rejection of all or any part of an Order.

Any samples, pictures or representations provided by OLDE WOOD of reclaimed, Traditional Plank, or other products are to demonstrate the general characteristics and appearance of that product and are in no way a guarantee of the actual characteristics of the products delivered to fulfill the Order.

OLDE WOOD and Buyer are independent contracting parties and nothing in this Agreement shall make either party the agent or legal representative of the other for any purpose whatsoever, nor does either party grant the other authority to assume or create any obligation on behalf or in the name of the other.

OLDE WOOD shall not be responsible for any acts or omissions, nor for events beyond its reasonable control (hereinafter referred to as “Force Majeure”), including but not limited to Acts of God, changes of laws or regulations or other acts of government, labor disputes, strikes, riots, mobs, fires, floods, wars, embargoes, pandemics, impossibility to obtain necessary material, labor, machinery, or transportation.

The Buyer acknowledges that OLDE WOOD possesses certain confidential or proprietary information of OLDE WOOD, including, without limitation, OLDE WOOD’s designs, data, ideas, drawings, specifications, trade secrets, formula, technical experience, financial data, financial information, products, and services, and other valuable, confidential and proprietary information, which may be disclosed to Buyer or for which Buyer may have access (hereafter “Confidential Information”). At all times thereafter, Buyer agrees not to disclose to any person, firm, or entity any Confidential Information. Furthermore, OLDE WOOD retains exclusive ownership and rights to all of its Confidential Information, trade secrets, and all of its intellectual property and other rights, as well as exclusive rights to any improvements, modifications, or variations of its products. Furthermore, Buyer shall have no right to use the name, likeness, logo, or other identifying marks of OLDE WOOD without the express written consent of OLDE WOOD.

This agreement shall be interpreted under the laws of the State of Ohio. Buyer agrees that the laws of the State of Ohio shall control in any dispute. THE PARTIES HERETO WAIVE ANY OBJECTION WHICH EITHER MAY HAVE BASED ON LACK OF JURISDICTION, IMPROPER VENUE OR FORUM NON CONVENIENS TO ANY SUIT OR PROCEEDING ARISING OUT OF THIS AGREEMENT BROUGHT IN THE STATE OR FEDERAL COURTS WITH JURISDICTION OVER THE CITY AND COUNTY OF MAGNOLIA, OHIO, WHICH SHALL BE THE EXCLUSIVE JURISDICTION FOR ANY SUCH ACTION. IN ANY LEGAL ACTION, PROCEEDING, CAUSE OF ACTION, OR COUNTERCLAIM ARISING OUT OF OR BROUGHT HEREUNDER OR OTHERWISE RELATED TO THE TRANSACTION CONTEMPLATED HEREBY, THE PARTIES WAIVE THEIR RIGHT TO A TRIAL BEFORE A JURY TO THE FULLEST EXTENT PERMITTED. The prevailing party in any litigation arising from this Agreement shall be entitled to an award of its reasonable legal fees and costs incurred in the defense or prosecution of such action.

This Agreement shall be binding and inure to the benefit of the parties, their personal and legal representatives, their heirs and beneficiaries, and their assigns and successors-in-interest. Buyer may not assign this Agreement without the prior written consent of OLDE WOOD. This Agreement contains the entire agreement, understanding and representation between the parties and supersedes all prior or current communications or proposals; oral or written, relating to the subject matter hereof. This Agreement may not be modified or rescinded unless in writing and executed by the parties. In the event any provision hereof is found invalid or unenforceable according to its terms, such provision shall be enforced or severed to the extent possible without affecting the remainder of the Agreement.

A party’s failure to insist on compliance or enforcement of any provision herein shall not affect the validity or enforceability or constitute a waiver of future enforcement of that provision or of any other provision herein by that party or any other party.

Except as expressly set forth in this Order, all products sold by OLDE WOOD are sold “AS IS”, “WITH ALL FAULTS” and with no warranties expressed or implied, including but not limited to any warranties of merchantability or fitness for a particular purpose. OLDE WOOD SHALL NOT BE LIABLE TO BUYER OR TO ANY PERSON WHO PURCHASES FROM BUYER OR USES ANY PRODUCT SUPPLIED BY OLDE WOOD FOR DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR LOSS OF PROFITS RESULTING FROM ANY CAUSE WHATSOEVER, INCLUDING, WITHOUT LIMITATION, ANY DELAY, ACT, ERROR, OR OMISSION OF OLDE WOOD. BUYER ACKNOWLEDGES THAT NO REPRESENTATIONS OR WARRANTIES WERE MADE OR RELIED UPON WITH RESPECT TO THE QUALITY AND FUNCTION OF THE PRODUCTS SUBJECT TO THIS AGREEMENT. NO OLDE WOOD EMPLOYEE OR AGENT, NOR ANY OTHER PERSON, IS AUTHORIZED TO ASSUME FOR OLDE WOOD ANY RESPONSIBILITY OR LIABILITY OTHER THAN THOSE APPEARING IN THIS AGREEMENT.

OLDE WOOD accepts no liability or responsibility for damage, injury, or harm to people and/or property resulting from the processing, installation, maintenance, use or operation of OLDE WOOD products. Buyer will indemnify, defend and hold OLDE WOOD and its members, managers, employees, contractors and agents harmless from and against all loss, liability, cost (including reasonable legal fees and costs), damage, or expense incident to any claim, action, proceeding, or judgment (including, but not limited to, claims of third parties) against OLDE WOOD arising out of (i) the processing, installation, maintenance, use or operation of OLDE WOOD products by Buyer, its agents, employees, representatives, subcontracts, or any other third party; (ii) Buyer’s breach of this Agreement; or (iii) any act or omission of Buyer or its agents, employees, representatives or subcontractors.

No changes in the Order or the products shall be made by Customer unless evidenced by a written agreement signed by OLDE WOOD. OLDE WOOD reserves the right to change the order when necessary.

Buyer has read and understands the Terms and Conditions and agrees that Buyer has accepted and acknowledges any and all Terms and Conditions or any attachments hereto. Any additional or contradictory terms or conditions contained in any acknowledgment, invoice, purchase order, change or other communication, oral or written, heretofore or hereafter furnished by Buyer is hereby objected to by OLDE WOOD, and shall be of no force or effect. In addition to any other means of acceptance and acknowledgment as referenced herein, Buyer’s payment of a deposit will also constitute acceptance and acknowledgment of these Terms and Conditions and acceptance of the estimate/order as written.

Flooring Acclimation - Acclimation time frame is dependent on many factors including the conditions and climate at the time of delivery. The goal is to ensure the moisture content of the wood is relative to the living conditions and remains consistent; generally, industry recommends a 30-50% humidity level and 60-80 degree temperatures (Fahrenheit). Industry acclimation recommendations for unfinished is 7-10 days and finished 10-14 days.

Flooring Installation - Although there are many different thoughts and practices on which installation method is best, Olde Wood recommends adhering to the National Wood Flooring Association guidelines on hardwood floor installation that can be found on our website.

Reclaimed Barn Siding Characteristics in these products may include but are not limited to sound/open knots, sound checking, nail holes, color contrasts, worm holes, small bolt holes, original surface patina, saw marks, over/under wood.

Please note that due to the multitude of paint bases introduced over the many years this product was used, it may have traces of lead-based paint still on it. OLDE WOOD cannot guarantee that any Original Paint products do or do not contain this. If this concerns you in any way, please consider our Pre-finished siding products, which are made using a water-based paint. If you have any other questions, please call/ask your sales representative.

Rough Stock Barn Siding Characteristics

This product will come standard in 5” and wider and 3’ and longer just as it came from the barn. Depending on the inventory, your order may consist of all one nominal width or an assortment of 2 or more random widths. On average you could see anything from 5 inches to 11 inches wide and lengths up to 12 feet. OLDE WOOD attempts to leave as much of this in its natural state to provide the original look as if it was just taken off the barn and put into your order. Of course, OLDE WOOD does surface denail, kiln dry, brush, and remove any major defects. Each structure is unique in the widths and lengths of planks that were used so each order will be unique as well. If you are looking for specific widths and/or lengths, please ask your sales representative for custom pricing.

4/4” Rough Stock - Nominal Thickness in this product ranges from 7/8” - 1-1/4” due to natural characteristics of the wood. Nominal Widths in this product vary as well plus or minus 1/2” in most cases.

8/4” Rough Stock - Nominal Thickness in this product ranges from 1-1/2” - 2-1/4” due to natural characteristics of the wood. Nominal Widths in this product vary as well plus or minus 1/2” in most cases.

Mantels - characteristics in these products may include but not limited to natural weathering, authentic cuts, artifacts, peg holes and mortise notch pockets. Included: Kiln dried. Surface de-nailed only - nails, etc. may exist below the surface. The Buyer is required to have the proper equipment for unloading. Mantels are inventoried and sold plus or minus 1”. OLDE WOOD allows a 1” variance on our Reclaimed Hand Hewn Timbers. EX: 10” x 10” beam may measure 9” x 10” in the center but on both ends measures 10” x 10”. Please make sure to unwrap mantels as soon as they are received so any built up moisture is released and the mantels can acclimate.

Timbers - characteristics in these products may include but not limited to natural weathering, authentic cuts, artifacts, peg holes and mortise notch pockets. Included: Kiln dried. Surface de-nailed only - nails, etc. may exist below the surface. The Buyer is required to have the proper equipment for unloading. Over-length will be billed and shipped. Please allow 15-20% on the final invoice for length overages. EX: Ordered 10 inch x 10 inch x 16 feet beam and OLDE WOOD ships a 10 inch x 10 inch x 18 feet the invoice reflects the extra 2 feet. Timbers are inventoried and sold plus or minus 1”. OLDE WOOD allows a 1” variance on our Reclaimed Hand Hewn Timbers. EX: 10” x 10” beam may measure 9” x 10” in the center but on both ends measures 10” x 10”. PLEASE NOTE THAT A FINAL SHIPPING ESTIMATE WILL NOT BE AVAILABLE UNTIL THE ENTIRE ORDER IS PACKAGED AND READY TO SHIP. THE SHIPPING COST THAT HAS BEEN INCLUDED IS ONLY AN ESTIMATE AND CAN CHANGE BASED ON WEIGHT AND SKID DIMENSIONS NEEDED TO PROPERLY PACKAGE YOUR ORDER. OLDE WOOD IS NOT RESPONSIBLE FOR ADDITIONAL SHIPPING CHARGES THAT MIGHT BE INCURRED AT TIME OF FINAL BILL.

3-Sided Hand Hewn Timber Skins – Thickness on this product can range from nominal 1-1/2” to 2” thickness. Nominal Width can range +/- 1”. This product will have hand hewn marks on 1 face and 2 edges of the piece. Due to this product being made by hand using an axe, there are variances in thickness and width from piece to piece.

3-Sided Rough Sawn Timber Skins – Thickness on this product can range from nominal 1-1/2” to 2” thickness. Nominal Width can range +/- 1”. This product will have Original Rough Saw marks on 1 face and 2 edges of the piece. Due to this product being made with rough saws, there are variances in thickness and width from piece to piece.

Hand Hewn Sleeper Skins – Thickness on this product can range from nominal 1-1/2” to 2” thickness. Nominal Width can range +/- 2”. This product will have hand hewn marks on 1 face. Due to this product being made by hand using an axe, there are variances in thickness and width from piece to piece. Width measurement is taken from the widest edge to the widest edge of the skin and not the hewn face.

Hand Hewn Box Beam Skin – Thickness on this product is nominal 1” thickness. Nominal Width can range +/- 1”. This product will have hand hewn marks on 1 face and 2 edges will be ripped. Due to this product being made by hand using an axe, there are variances in thickness from piece to piece.

Rough Sawn Box Beam Skin – Thickness on this product is nominal 1” thickness. Nominal Width can range +/- 1”. This product will have original rough saw marks on 1 face and 2 edges will be ripped. Due to this product being made by hand using an axe, there are variances in thickness from piece to piece.

OLDE WOOD is not responsible for the structural integrity of timbers. The primary use of these timbers is for aesthetic purposes only. If you wish to use these timbers for structural purposes, please contact a civil engineer. OLDE WOOD is not responsible for any additional cost that may be incurred.

Flooring Transit - Flooring is shipped common carrier. Carriers require a contact name and contact number. The Buyer is responsible for unloading all material from back of the delivery truck to designated staging area. The material is commonly packaged for forklift unloading. Proper equipment required for unloading. If the product will be hand unloaded, please inform OLDE WOOD at the time of deposit. Freight estimates are based on normal unloading times. Hand unloading may exceed normal unloading times and are subject to additional charges. Additional unloading charges will be the responsibility of consignee.

Timber Transit - Timbers are shipped common carrier. Carriers require a contact name and contact number. The Buyer is responsible for unloading all material from back of the delivery truck to designated staging area. The material is commonly packaged for forklift unloading. Proper equipment required for unloading. If the product will be hand unloaded, please inform OLDE WOOD at the time of deposit. Freight estimates are based on normal unloading times. Hand unloading may exceed normal unloading times and are subject to additional charges. Additional unloading charges will be the responsibility of consignee.

Shipping Damage - OLDE WOOD ships common carrier. Shipping damage, however unusual, may occur. If a shipment is received damaged it must be noted on the delivery receipt. Taking pictures of damage material is encouraged. OLDE WOOD will not be responsible for filing a claim with the freight company without a notation on the delivery receipt.

The Buyer is responsible for unloading all material from back of the delivery truck to designated staging area. This means that you will need to physically move the material off the truck. The driver will not unload the pallet(s). You will need to offload by hand or with proper equipment. If a shipment is received damaged it must be noted on the delivery receipt. OLDE WOOD will not be responsible for filing a claim with the freight company without a notation on the delivery receipt.

***Please understand that deliveries are not available on Saturdays unless special arrangements are made and Saturday delivery is noted on the order. Saturday deliveries will also incur additional delivery charges.

Lead Time Estimate - Lead time estimates are valid for one week. Lead times are based on product availability and production scheduling. Lead times are subject to change. Manufacturing lead time starts the date of deposit confirmation. Please call or email for updated lead times.

Freight Estimate - Freight estimates are valid for one week. Freight estimates are based on the type of material, cubic space, weight, and traveling distance. Freight estimates are subject to change.

Adjustments will be applied to the final invoice. Please call or email for updated freight estimates.

Packaging – milled products are packaged in vinyl strapped individual packages and shipped on a custom-built pallet for forklift unloading. The forklift units are covered with lumber wrap and banded. Rough Stock products are not packaged in individual bundles.

Custom Hand Scraping - Please understand that custom hand scraping is a random process, and there is no way to exactly match any sample provided for reference. Levels of scraping are used for overall reference only.

Samples - Samples and submittal samples of this natural material are to be used as a general guide. Samples are not a direct representation on an entire floor. Samples, pictures or representations we provide are to demonstrate the general characteristics and appearance of that product and are in no way a guarantee all characteristics are shown or all characteristics shown will appear in your order. Every flooring piece and completed floor is truly unique and one of a kind.

Random Lengths - our floors/walls/ceiling products are commonly manufactured in random lengths. Random lengths are commonly 2’-10’ or 2’-12’ and vary based on the wood selection. Each floor is produced for optimal yield, and the length results vary with each floor. Random lengths mean you will receive boards up to 10’ or 12’. However, no way guarantees you will receive 10’ or 12’ lengths or a percentage of any one length. Specified Lengths or custom lengths are available. Please ask your Design Specialist for information and pricing if you would like this option.

Random Widths - our products are commonly manufactured in random widths will vary based on the wood selection. Each floor is produced for optimal yield, and the width results vary with each floor. Random width flooring is more traditional and available in a number of width ranges. Random width no way guarantees you will receive a percentage of any one width. Specified widths are available upon request. Please ask your Design Specialist for information and pricing if you would like this option.

Natural Oil Pre-Finish Characteristics - This product has a natural oil-based finish that uses oxygen to cure/harden. Once the flooring has arrived, please unpackage as soon as possible and allow the product 48 hours to cure completely. If you have any other questions, please talk with your sales representative.

Prefinished Products - characteristics in these products may include but are not limited to sound/open knots, sound checking, nail holes, color contrasts, worm holes, small bolt holes, original surface patina, saw marks, over/underwood. Many of these characteristics will be filled during pre-finish to provide a quality product. The cost of Pre-finish depends on quantity ordered. Larger orders will cost less compared to smaller orders of the same product and finish. When ordering prefinished products, the finish only covers the face of the wood and not the sides or tongue and groove. In products containing over/under wood, there is the potential to see the unfinished edge of the plank when installed. This is normal and acceptable. During the process of sanding and finishing, the thickness of the flooring will be adjusted to create a high quality finished product. UV- Finish - Our Standard UV-cured and Natural Oil pre-finish flooring planks carry a 20-year residential / 5-year commercial limited warranty and can be easily cleaned. Warranty is voided if any cleaners are used on the floor other than the recommended OLDE WOOD cleaning products. This warranty does not cover natural wear but covers the adhesion of the finish to the wood. The Natural Oil has no warranty on the wear of the finish since it is a sealer, but again OLDE WOOD guarantees the proper application and adhesion of the finish to the wood. Oil Manufacturer recommends that a refresh coat be applied to the product once it has been installed (http://www.oldewoodltd.com) Filling includes the filling of most Knot Holes, End and Face Checks (no worm holes or similar characteristics).

Tread Products - characteristics in these products may include but are not limited to sound/open knots, sound checking, nail holes, color contrasts, worm holes, small bolt holes, original surface patina, saw marks, over/underwood. Once the tread has been modified on site and attached or installed, OLDE WOOD cannot be held responsible for improper installation or misuse.

Please understand that lead times are based on scheduling and are subject to change due to orders received. Lead-times are good for only one week. Please call or email anytime for updated lead-time. Transit time is not included in manufacturing lead-time. Transit time noted in shipping estimate. If the material is needed sooner, please inform us.

It is the Buyer responsibility to verify the flooring moisture levels are appropriate (6% - 8%). Any moisture claim must be filed within 3-days of delivery.

When calculating normal installation square footage, industry standards recommend adding a 5% - 10% waste factor. OLDE WOOD does not accept responsibility for calculating waste factors.

OLDE WOOD does not accept responsibility for actual blueprint takeoff results. This estimate is only a suggestion of the total square footage and product list. Actual square footage to be provided by Architect or General Contractor
